Eligibility
This contest is open to the US residents. This contest, and all promotions relating thereto, are subject to all local laws and regulations. Entrants must be at least eighteen (18) years of age. By participating, entrants agree to abide by these Official Rules and the decisions of OMMA Cosmetics, which are final and binding in all respects.
Entry Period
Entries will open on October 15, 2022 and end on October 15, 2023 (the “Entry Period”), after which time the contest will be closed and no further entries will be accepted.
OMMA Cosmetics is not responsible for any type of technical difficulty (including, but not limited to: network server issues, connection problems, failed phone, computer, or telephone transmission, any type of technical failure), or any other type of error whether human, or mechanical. Any type of entry that does not follow rules is automatically disqualified. OMMA Cosmetics reserves the right, in its sole discretion, to suspend or cancel the contest at any time if a computer bug, virus, or other problem corrupts the administration, security, or proper conduct of the contest.
How to Enter
To enter the OMMA Cosmetics Skincare Contest, take a photo of your OMMA Cosmetics products in a bright area, make sure to be creative. Show your products or your skincare routine while using them. Upload your video or photo on Instagram or TikTok. Make sure to tag us at @omma.cosmetics and use #ommacosmetics in the description.
The amount of time it takes for your entry to upload will depend on the size of your photo or entry, your connection speed, the volume of online traffic, and other factors. Please use good judgment and eliminate any inappropriate language or content from your images or entry. Entries must not defame, misrepresent, or make disparaging remarks about the OMMA Cosmetics, any of its products, or other individuals, products, or businesses. They also cannot convey messages or images that seem to be inconsistent with the goodwill and/or positive image that the OMMA Cosmetics aspires to.
By participating, you agree that, at the OMMA Cosmetics’ sole discretion, your entry may be posted on the OMMA Cosmetics’ website(s) or other media platforms. OMMA Cosmetics has no obligation to use or post any photo you submit. Any and all portions of the entries may be copied, published, broadcast, displayed, distributed, used, edited, translated, altered, combined with other materials, reused, and/or modified by the OMMA Cosmetics in any way and for any purpose at any time in any now-existing or yet-to-be-developed medium around the world. Online entries received outside of the Entry Period or not in compliance with these Official Rules as set out above will be disqualified..
Entries cannot promote illegal drugs, alcohol, tobacco, firearms/weapons (or the use of any of the foregoing), any activities that may appear unsafe or dangerous, any specific political agenda or message, or be sexually explicit or suggestive, violent or derogatory of any ethnic, racial, gender, religious, professional, or age group; or contain nudity or any materially dangerous activity. It should not contain any personal information, such as license plate numbers, names, e-mail addresses, or street addresses; (e) include without permission works of art, such as photographs, sculptures, paintings, or other images that are protected by third-party intellectual property rights; (f) include without permission materials that bear the names, likenesses, photographs, or other identifiers of any living or deceased person.
By submitting an entry, you guarantee and represent that it is your original work, hasn't been published before, hasn't won any prior awards, doesn't violate anyone else's copyrights, trademarks, privacy rights, or other intellectual property rights, and that you have permission from any third parties whose names, similarity, voices, or other proprietary rights are used in the entry. Any such participant will respect and hold OMMA Cosmetics harmless from any claims to the contrary. Any participant whose entry contains images, the resemblance of another person, or other elements that are not their own (such as, but not limited to, representations of people, buildings, trademarks, or logos) must be able to provide legal releases for such use, including use by OMMA Cosmetics, in a form that is acceptable to OMMA Cosmetics, upon request, prior to awarding prizes.
You must obtain a consent form from the subject, or in the instance of a minor, the subject's parent or legal guardian, and submit it to the OMMA Cosmetics upon request for any image in which a person may be recognized. Photos that infringe on or violate the rights of another individual, including copyright, are not eligible.
Judging Criteria
Eligible entries will be judged by panel of judges, based on the following criteria:

Decisions of the judges are final in all respects.
Prizes
Multiple winners may be selected during this time period. Each of the selected winners will each receive a WOW Patch Mega Bundle. All qualifications must be met in order to win, and those who are chosen must abide by all terms and restrictions of these Official Rules. All prizes are given away "as is" with no express or implied guarantees. If by reason of a printing, typographical, administrative or other error, more prizes are claimed than the all persons presenting apparently valid claims shall be counted toward the number specified in these official guidelines. There won't be any more prizes given out than what was specified. The prize will be shipped to the winner at the expense of OMMA Cosmetics.
Winner Selection
Multiple winners will be selected by a panel of judges on a rolling basis ending October 15 2023, and will be notified via social media direct message. Within 30 days of notice, the winner may need to sign and return the necessary notarized Affidavit of Eligibility/Release of Liability. Affidavit of Eligibility/Release of Liability must be submitted within two months of the receipt of the award notification. If a winner doesn't respond to notifications, doesn't submit the necessary paperwork within 30 days, or doesn't follow any other rules, they risk being disqualified and a new winner will be chosen in their place. The applicable prize will be awarded to an alternate winner if a prize notice or item is returned as undeliverable for any reason. Prizes are non-transferrable, assignable, or exchanged for cash. In its sole discretion, OMMA Cosmetics reserves the right to swap a prize with one of equal or better value. All choices are irrevocable. The winners are liable for all tax obligations.
General Conditions
If any fraud, technical issues, or other circumstances outside of OMMA Cosmetics’ reasonable control compromise the integrity or proper functioning of the Promotion, as determined by OMMA Cosmetics in its sole discretion, OMMA Cosmetics reserves the right to cancel, suspend, and/or modify the Promotion, or any part of it. When it comes to lost, interrupted, or unavailable network, server, or other connections, garbled transmissions or miscommunications, telephone transmission issues, computer or software malfunctions, damage to a user's computer equipment (software or hardware), technical failures, and other mistakes or malfunctions of any kind, whether caused by humans, machines, or electronics, OMMA Cosmetics and its agents disclaim all liability. Proof of emailing or submitting an entry will not serve as evidence of the OMMA Cosmetics receiving it. OMMA Cosmetics’ failure to enforce any term of the Official Rules and General Terms shall not constitute a waiver of that provision.
WARNING: ANY ATTEMPT BY AN ENTRANT OR ANY OTHER PERSON TO WILLFULLY DAMAGE ANY WEBSITE OR SOCIAL MEDIA PLATFORM ASSOCIATED WITH THE PROMOTION OR UNDERMINE THE LEGITIMATE OPERATION OF THE PROMOTION MAY BE FRAUDULENT AND MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAW. SHOULD SUCH AN ATTEMPT BE MADE, OMMA COSMETICS RESERVE THE RIGHT TO SEEK DAMAGES AND SUE ANY SUCH INDIVIDUAL TO THE EXTENT PERMITTED BY LAW.
Any person found to be trying to tamper with or undermine the entry process, any website connected to the Promotion, and/or the proper conduct of the Promotion, to violate the Official Rules and General Terms, to act in a bad sportsmanship or disruptive manner, or with the intention to annoy, abuse, threaten, or harass any other person, will be disqualified at OMMA Cosmetics' discretion. In the event that the Promotion cannot proceed as planned for any reason, OMMA Cosmetics reserves the right, in its sole discretion, to (a) void any suspect entries, modify or suspend the Promotion in order to address the impairment, and then resume the Promotion in a manner that best embodies the spirit of the Official Rules and General Terms, or (b) select a winner at random from among all eligible, non-suspect entries received up until the time of the impairment.
Publicity Release
Except where prohibited by law, each winner hereby grants to OMMA Cosmetics, its subsidiaries, affiliates, retailers, distributors, advertising, sweepstakes and similar promotional agencies, suppliers, and those acting on its behalf, the right and permission to print, publish, broadcast, and use, worldwide in any media now known or hereafter developed, including, but not limited to, the world wide web.
Intellectual Property
By submitting an entry, the entrant agrees that, with the exception of personally identifiable information as described in OMMA Cosmetics' Privacy Policy, all Content Submissions that the entrant may submit to OMMA Cosmetics or otherwise post in connection with the Promotion, including all rights embodied therein, are deemed to be non-confidential and non-proprietary, and OMMA Cosmetics shall have no obligation to maintain the confidentiality of any such information. Without payment, permission, or notification to the participant or any third party, OMMA Cosmetics shall be free to edit, exploit, modify, publish, reproduce, use, disclose, disseminate, and distribute the Content Submission to others without restriction in any and all media now known or not currently known, throughout the world, for any purpose. Entrant acknowledges and agrees that if OMMA Cosmetics uses the Content Submission, entrant will not be entitled to any credit, consideration, notice, or payments of any kind. Entrant hereby grants to OMMA Cosmetics and its affiliates and their legal representatives, successors and assigns, an irrevocable, and worldwide license to use the Content Submission in any form or format and to modify the same for a period of ten (10) years, renewable at OMMA Cosmetics' option. Entrant waives any moral rights to the Content Submission that he or she may have and acknowledges that, in the event OMMA Cosmetics chooses to use the Content Submission for any purpose, all copyright or other intellectual property rights resulting from the entrant's Content Submission or from OMMA Cosmetics' use of the same shall belong exclusively to OMMA Cosmetics. Entrant additionally agrees that, should OMMA Cosmetics decide to use his or her Content Submission, entrant will sign any paperwork that OMMA Cosmetics requests in connection with this assignment. Entrant agrees to hold OMMA Cosmetics and its agents, employees, affiliates, subsidiaries, representatives, and all related parties harmless from and against any and all damages, costs, judgments, and expenses (including reasonable attorney fees) that it may incur as a result of its use of the Content Submission, should OMMA Cosmetics use of the Content Submission render it liable to any third party.
For the sole purpose of taking part in the Promotion, OMMA Cosmetics offers participants a limited, revocable, non-sublicensable license to use OMMA Cosmetics' name, products, trademarks, and logos. The intellectual property of OMMA Cosmetics may not be used in any other way by participants. Additionally, participants acknowledge that OMMA Cosmetics shall exclusively own all rights, titles, and interests in the OMMA Cosmetics Intellectual Property (IP), and each participant guarantees that they have not taken and will not take any actions that might jeopardize or otherwise affect these rights. Except for the restricted license given to participants in accordance with the terms of this agreement, no right, title, or interest in or to the OMMA Cosmetics IP is transferred or generated.
Release & Limitations of Liability
By taking part in the Promotion, Participants acknowledge and agree that OMMA Cosmetics, the applicable social media platform provider (Instagram), and each of their respective affiliates, subsidiaries, representatives, consultants, contractors, legal counsel, advertising, public relations, promotional, fulfillment, and marketing agents and agencies, website providers, webmasters, and officers, directors, employees, representatives, and agents (the "Releases") are independent contractors and are not responsible for any claims made by Participants.
- any incorrect or inaccurate information, whether brought in by participants, printing mistakes, or issues with any tools or software connected to or used in the Promotion
- technical faults of any sort, including but not limited to phone line issues, network software or hardware issues, or disconnections;
- any uninvited human involvement with the admittance procedure or the promotion;
- any technical or human error in the administration of the Promotion or the entry processing;
- any harm or damage to persons or property that may result from an entrant's participation in the promotion, or from their acceptance, use, or misuse of any prize, whether directly or indirectly, completely or in part.
No more awards will be given out than what is stated. In the event that there are more prizes available or claimed than are specified in the Official Rules and General Terms due to production, technical, seeding, programming, or other factors, OMMA Cosmetics reserves the right to award only the specified number of prizes by random drawing from among all eligible, valid, and unawarded prize claims.
By participating in the promotion, participants agree that the released parties will not be responsible for any injuries, losses, or damages of any kind to people or property arising in whole or in part, directly or indirectly, from acceptance, possession, misuse, or use of the prize, entry, or participation in the promotion or in any related activity, including, but not limited to, participating in the promotion.
In the event that a prize cannot be given owing to canceled travel, the released parties are not liable, delays, or interruptions due to natural disasters, weather, or terrorism; defamation or invasion of privacy; or merchandise delivery.
Without limiting the aforementioned, all items connected with the promotion, including any websites and all prizes, are provided "as is" without any express or implied warranty of any kind, including, but not restricted to, the implied warranties of merchantability, fitness, or non-infringement. Check local laws for any restrictions or limitations relating to these limitations or exclusions as some jurisdictions may not allow the limitations or exclusions of liability for incidental. Some of the aforementioned limitations or exclusions may not apply, such as the exclusion of implied warranties or consequential damages.
Disputes
Except where prohibited by law, each participant acknowledges and agrees that: (i) any and all claims, judgments, and awards arising out of or connected with this Promotion or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the Court of USA; and (ii) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Promotion. All claims relating to or arising out of this contract, or its breach, whether based in contract, tort, or otherwise, will be governed by the laws of the US, excluding that state's choice-of-law principles. The Official Rules and General Terms will be governed by, and interpreted in accordance with, the laws of the US.
Privacy Policy
Each entrant is aware that they are sending personal information to OMMA Cosmetics and any social media platform provider (or its affiliates) when they submit their entry, and that this information will be subject to OMMA Cosmetics' Privacy Policy (or its affiliates). The personal information that participants submit with their entries may be used by OMMA Cosmetics and OMMA Cosmetics' agents, affiliates, subsidiaries, representatives, or service providers for the administration of the Promotion (including but not limited to contacting and announcing the winner), for prize fulfillment, and/or for future marketing by OMMA Cosmetics and its affiliates, such as to inform participants of a product or promotion that OMMA Cosmetics or its affiliates believe may be of interest to them. If a participant has any concerns an entrant may email OMMA Cosmetics at Support@ommacosmetics.com and/or @omma.cosmetics (Instagram) with any questions or concerns regarding the use of personal information by OMMA Cosmetics or its affiliates. In the event that OMMA Cosmetics needs to get in touch with a contestant regarding an occurrence involving the contestant's personal information, it may do so via email, direct message, phone, or mail.
Social Media Platform Disclaimer
If the promotion is being run on a social media platform, participants in the promotion are also subject to that social media platform's data policy, privacy policy, terms of service, or other similar policies by using that social media platform to participate in the promotion. Entrants acknowledge that the applicable social media platform(s), its owner, officers, directors, employees, and agents are not responsible for the operation of any social media platform on which the Promotion is being run, promoted, and/or publicized. Entrants acknowledge that the applicable social media platform(s) is/are not in any way affiliated with, sponsored, administered by, or endorsed by the Promotion. The applicable social media platform, as well as its officers, directors, employees, and agents, are expressly released from any and all liability related to the Promotion by Entrants.
Waiver of Equitable Relief/Nature of Relationship
Each participant is aware and agrees that OMMA Cosmetics has access to a variety of concepts, styles, and other resources, and that it frequently receives fresh suggestions or develops them itself. Each participant also understands that a number of concepts may be in direct competition, similar to, or identical to the Content Submission and/or each other in terms of theme, concept, format, or other factors. Each participant understands and agrees that OMMA Cosmetics' use of any such similar or identical material will not entitle them to any compensation. Each participant understands and accepts that OMMA Cosmetics has no obligation to and will have no liability for any infringement or protection of the copyright in or to the Content Submission, whether direct, indirect, vicarious, contributory, or otherwise. Last but not least, each participant recognizes that, with regard to any claim by participant relating to or arising out of OMMA Cosmetics' real or claimed exploitation or use of any Content Submission or other materials provided in conjunction with the Promotion, the harm, if any, thereby caused to the applicable entrant will not be irreparable or sufficient in any other way to entitle such entrant to seek injunctive or other equitable relief or to in any other way enjoin the production, distribution, exhibition, or other exploitation of the Content Submission or any material based on or allegedly based on the Content Submission, and the entrant's rights and remedies in any such event shall be strictly limited to the right to recover damages.
